Vessel worker suffered second-degree burns over 45% of his body, obtains 6 million dollar verdict

According to news reports, a 37 year old deckhand working aboard a vessel owned by Schlumberger has obtained a 6 million dollar verdict, plus court costs, after he was burned over 45% of his body.

A tank containing zinc bromide mixed with sand overheated, causing a plumbing failure.  This resulted in the worker being drenched with hot zinc bromide and being severely burned.

He was burned over 45% of his body, including his eyes.  The worker suffers from high blood pressure, depression, and post-traumatic stress disorder.

The worker filed a lawsuit against the vessel and her owner under the Jones Act and general maritime law.

After a bench trial, the judge awarded the worker $5.64 million dollars.  With interest, the award came to $6 million dollars.

Helicopter crash in the Gulf of Mexico kills 3 oil rig workers

Various news sources are reporting that a helicopter crash in the Gulf of Mexico has killed 3 oil rig workers on their way to an unmanned oil platform in the Gulf of Mexico. 

The Gulf Coast has seen entirely too many helicopter crashes in 2008.  Something should be done to increase the safety of helicopters along with monitoring and enforcing safety laws that apply to helicopter companies.The image “http://www.srh.noaa.gov/lch/obs/rig.jpg” cannot be displayed, because it contains errors.

What law applies to a helicopter crash over a navigable body of water like the Gulf of Mexico?

This analysis is extremely complicated.  Only a very experienced maritime attorney will be able to steer you through the proper legal analysis.

Houston and the surrounding community is the fourth-largest city in the United States.  It is also one of the most industrialized areas in the U.S.

As an unfortunate result, there are a lot of on the job injuries in Houston

Unlike every other state in the United States, Texas does not require employers to carry workers compensation insurance. 

Workers compensation insurance is meant to protect workers who are hurt on the job.  Unfortunately, the Texas Workers Compensation system is now run by the huge insurance companies, so workers almost always get the short end of the stick.

And the Texas courts, at least for now, have basically given construction companies immunity to anyone injured on their jobsite that is building the house as long as the words "independent contractor" are used.

To say the scales are tilted against injured workers in Texas would be an understatement.

Kids and bike accidents - How to reduce injuries

The other day I taught my son to ride his bike.  He is five years old.  It also happened to be my birthday.  What a wonderful birthday present to see your son learn how to ride his bike.  After we were done, he said "thanks dad."  Truly a joyous day for a father.

Union Pacific Railroad loses jury verdict to injured railroad worker

Union Pacific Railroad recently lost a $5,390,000.00 jury verdict against an injured railroad employee.

The employee was using a hayfork to lift 10-pound oil filters into a crusher.  He injured his low back while doing that work, requiring three back surgeries. 

The injured railroad worker sued his employer, Union Pacific Railroad, under FELA, the Federal Employees Liability Act. 

The jury awarded the worker $5,390,000.00.

Burn injuries on locomotive lead to settlement in railroad injury case

Recently, a railroad worker was trying to restart a locomotive when a coolant hose exploded, spewing hot fluid all over him and causing him to fall from the railroad platform to the ground.

He suffered burns over 7 percent of his body and needed arthroscopic surgery on his shoulder and right knee.  He also suffered post-traumatic stress disorder.

Following a jury trial, the jury awarded the injured worker $4,000,000.00 in damages.

Child drowning at apartment complex results in lawsuit against apartment complex

The Houston Chronicle is reporting today that the parents of a child who drowned at an apartment complex have sued the complex.

According to the lawsuit, the apartment complex did not have adequate fencing and the pool itself was in disrepair.

Fire at apartment complex kills five kids - Lack of smoke detectors blamed for the deaths - Complex pays substantial settlement to family

According to published reports, the owners and managers of an apartment complex have agreed to a settlement after a fire killed five kids.

Apparently, the apartment complex did not have properly working smoke detectors.  The family, which was poor, were using candles to light their apartment.

There were no working smoke detectors either in the apartment unit itself or in the common area hallway.  As a result, the family did not know a fire had started until it was too late.

The apartment complex's insurance company agreed to pay a substantial settlement as a result of the gross lack of attention to basic safety features like smoke detectors.

Train derailment kills Channelview man

The Houston Chronicle reports today that a man was killed when a train derailed and hit him.

The worker was standing between trains that were on parallel tracks when one train derailed. 

Investigators were trying to determine why the train left the tracks.  No information was available and the accident is still under investigation.

Our prayers to the family and friends of the railroad worker, and our best hopes and wishes that the investigators get to the bottom of this and don't let any cover-up occur.
